Terms of Service
Last updated 11 October 2026
Whysp AI, Inc., a Delaware corporation · shaurya.jain@whyspai.com
These terms are an agreement between you and Whysp AI, Inc., a Delaware corporation (“Whysp”, “we”), for your use of the Whysp AI website and app at whyspai.com (the “service”). By creating an account you agree to them. If you do not agree, do not use the service.
Who can use Whysp AI
You must be at least 13 years old, or 16 if you live in the European Economic Area or the United Kingdom, and old enough to agree to these terms where you live. If you use the service on behalf of an organisation, you confirm you are authorised to do so.
The service
Whysp AI shows messages from messaging accounts you choose to connect in one inbox, and can draft replies for you using AI. It is currently provided free of charge, as an early release, and may change, be interrupted, or be withdrawn.
Your account
- Provide a real email address and keep your password confidential. You are responsible for activity on your account.
- You may delete your account at any time from Settings.
Connecting messaging accounts
- Only connect accounts that are yours.
- Connections are made through open-source bridges that act as an additional device on your account. Whysp AI is not affiliated with or endorsed by any messaging platform.
- Your use of each messaging platform remains subject to that platform's own terms. A platform may limit, log out, or suspend accounts that use third-party clients. We cannot control or reverse those decisions, and you connect an account at your own risk.
- Integrations may stop working without notice if a platform changes how it operates.
AI drafts
- Drafts are generated by an AI model and may be inaccurate, incomplete, or unsuitable.
- Nothing is sent unless you press Send. You are responsible for every message sent from your accounts, whether or not it began as an AI draft.
- Do not rely on drafts for legal, medical, financial, or other professional advice.
Acceptable use
You agree not to use Whysp AI to:
- send spam, bulk, or automated unsolicited messages;
- harass, threaten, defraud, or impersonate anyone;
- break the law or the rules of the messaging platforms you connect;
- attempt to access other users' data, probe or disrupt the service, or circumvent its limits;
- resell or provide the service to others.
Your content
You keep all rights in your messages, writing samples, and other content. You give us permission to store and process them only as needed to provide the service to you, as described in the Privacy Policy.
Suspension and termination
We may suspend or close an account that breaks these terms or puts the service or other people at risk. You may stop using the service and delete your account at any time. When an account is closed, data is deleted as described on the Data deletion page.
No warranty
The service is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. We do not promise that it will be uninterrupted, error-free, or that messages will always be delivered or synchronised.
Limitation of liability
To the fullest extent permitted by law, Whysp and its officers and employees are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or access to accounts on third-party platforms, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us for the service in the twelve months before the claim, or US$50.
Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer under the laws of the country where you live.
Indemnity
If you use the service in breach of these terms or the law, and that leads to a claim against Whysp by someone else, you agree to cover the reasonable costs of that claim, to the extent the law allows.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Before starting any formal proceedings, please contact us so we can try to resolve the issue informally. Any dispute that cannot be resolved that way will be heard in the state or federal courts located in Delaware, unless the law of the country where you live as a consumer entitles you to bring proceedings in your local courts.
General
If any part of these terms is found unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it. You may not transfer these terms; we may transfer them as part of a reorganisation or sale of the business. These terms, the Privacy Policy, and the AI principles are the whole agreement between us about the service.
Changes to these terms
We may update these terms. If a change is significant we will tell you in the app or by email before it takes effect. Continuing to use the service after that means you accept the updated terms.
